Terms of Service

These Terms of Service (“Terms”) govern your use of the MOVE THAT COUCH! mobile application and related services (“the platform”). By creating an account or using the platform, you agree to these Terms.

MOVE THAT COUCH! is owned and operated by ZM Platforms LLC, a Texas limited liability company.

1. Platform Purpose & Relationship of the Parties

MOVE THAT COUCH! is a technology platform that connects customers and independent service providers for furniture delivery, assembly, mounting, and related light services. We do not provide transportation or labor services and do not operate as a carrier or service provider.

Drivers and service providers are independent providers and are not employees, agents, or contractors of MOVE THAT COUCH! All agreements, interactions, quotes, payments, and services are solely between customers and independent service providers. The platform is not responsible for loss, damage, delays, or service outcomes.

The platform facilitates connections only and does not arrange, manage, or provide delivery, shipping, freight, logistics, labor, or installation services.

2. Where the Platform Operates

MOVE THAT COUCH! is available in all 50 U.S. states and in U.S. territories, including Puerto Rico, Guam, the U.S. Virgin Islands, the Northern Mariana Islands, and American Samoa.

The platform is intended solely for deliveries that can be completed under the continuous custody of a single independent driver using standard road travel, where a drivable route exists between the pickup and drop-off locations, and for light services that can be completed by a single independent provider using standard tools and road travel, where applicable.

Deliveries that require international transit, customs processing, air or ocean transport, or handoff to another carrier or logistics provider are not supported.

Availability of the platform may vary by location, route, or service type. MOVE THAT COUCH! reserves the right to restrict or deny certain requests or routes.

3. Service Types & Limitations

MOVE THAT COUCH! may facilitate requests for services including, but not limited to:

The platform does not support requests involving:

Customers are responsible for ensuring that requested services are appropriate for a general labor provider and do not require specialized licensing.

4. Requests Not Supported on the Platform

MOVE THAT COUCH! is designed primarily for furniture-related services. Other requests may be allowed, provided they do not fall into the categories below.

The platform does not support requests involving:

MOVE THAT COUCH! is not a ride or passenger transportation service.

4.6 Vehicles, Boats, and Aircraft

This restriction applies to items or services being requested. Drivers may independently use their own vehicles, trucks, vans, or trailers as part of their equipment.

5. Driver & Service Provider Compliance, No Liability & No Insurance Provided

Drivers and service providers are solely responsible for complying with all applicable laws, regulations, licensing requirements, registration requirements, certification requirements, and insurance obligations applicable to the services they perform.

Service providers may choose to share information regarding insurance coverage, experience, qualifications, certifications, licenses, equipment, or other credentials through their profiles. Any such information is optional, self-reported by the service provider, and is not independently verified by MOVE THAT COUCH!.

Customers are responsible for reviewing provider profiles, ratings, reviews, photos, pricing, and other information made available through the platform before selecting a service provider.

MOVE THAT COUCH! does not inspect, verify, approve, certify, endorse, supervise, manage, direct, or control the services performed by independent service providers.

All vehicles, tools, equipment, materials, supplies, and methods used for services are selected and operated solely by the independent service provider.

MOVE THAT COUCH! is not liable for property damage, loss, injury, delays, service outcomes, or claims arising from services, deliveries, installations, assemblies, mounting services, junk removal services, or user interactions.

This includes, but is not limited to:

MOVE THAT COUCH! does not guarantee the quality, safety, legality, suitability, timeliness, completeness, or correctness of any work performed.

Services performed through the platform are not guaranteed to meet professional, licensed-trade, manufacturer, industry, or code-compliance standards.

6. Quotes, Scheduling, Booking Deposits, and Payments

6.1 Provider Quotes & Scheduling Terms

Drivers and service providers independently set their own prices, availability, and service terms, including proposed dates and time windows. Customers and service providers may negotiate price, date, time, and scope directly through the platform prior to booking.

Quotes may expire if not accepted within the timeframe shown or may be withdrawn by the service provider before acceptance.

6.2 Booking Deposits

When a customer accepts a quote, a 20% booking deposit based on the accepted quote is charged through the platform using Stripe.

In some cases, a customer or user managing a service on behalf of a client may send a payment request or payment link to a third party for payment of the booking deposit. Any person submitting payment through such a payment link acknowledges and agrees to the applicable quote, booking, cancellation, refund, and platform terms associated with that service request.

6.3 Rescheduling & Cancellation Policy

Customers and service providers may mutually agree to reschedule a booked service. However, for purposes of cancellation and refund eligibility, the original date and time agreed to at booking controls all cancellation logic.

If a customer cancels more than 48 hours before the originally booked service date and time, amounts paid through Stripe may be refunded to the original payment method, and any MTC Credits applied to the booking may be restored to the user's MTC Credit balance in accordance with platform policies.

If a customer cancels within 48 hours of the originally booked service date and time, the service provider receives 100% of the booking deposit.

If a service provider cancels a booked service for any reason, the booking deposit is automatically refunded to the customer.

Important timing rule: The 48-hour window is calculated from the accepted quote at booking, regardless of later discussions or rescheduling.

Stripe processes booking deposit refunds and late cancellation payouts.

7. Referral Program

MOVE THAT COUCH! may offer a referral program that allows users to earn referral bonuses by inviting new customers or service providers to the platform.

7.1 How Referrals Work

Referrals may occur through a user's referral link, referral QR code, referral code, or other referral methods made available by MOVE THAT COUCH!. Referral tracking and bonus calculations are handled automatically by the platform.

7.2 Bonus Structure

Referrers earn 10% of the booking deposit for each eligible completed service completed by a referred user.

Referral bonuses are calculated based on the booking deposit only and do not apply to the total service price.

7.3 Eligibility

Referral bonuses are paid only for completed services. No referral bonus is paid for canceled, refunded, disputed, fraudulent, or otherwise ineligible transactions.

Referrers must maintain an account in good standing at the time the referred service is completed in order to receive a referral bonus.

Referral bonuses and MTC Credits are not paid or awarded in cases of self-referral or where the referrer and referred user share the same payout destination or otherwise appear to be the same person. MOVE THAT COUCH! reserves the right to withhold, deny, revoke, adjust, or cancel referral bonuses or MTC Credits in cases of suspected abuse, manipulation, duplicate accounts, fraudulent activity, chargebacks, or violation of these Terms.

7.5 Payouts

Referral bonuses are paid through the platform’s designated payout provider. Users are responsible for maintaining accurate payout information and complying with any tax reporting obligations associated with referral earnings.

7.6 Promotional Credits & Incentive Programs

MOVE THAT COUCH! may offer promotional credits, rewards, incentives, referral programs, review programs, early-adopter programs, or other promotional campaigns from time to time.

Such programs may award MTC Credits or other promotional benefits to eligible users for actions such as:

MTC Credits used toward a booking deposit may be forfeited if a booking is canceled within a period that would otherwise trigger a provider cancellation payout.

7.7 Program Changes and Termination

The referral program and any promotional credit programs are offered at the sole discretion of MOVE THAT COUCH!. We reserve the right to modify, suspend, or terminate such programs, or adjust referral bonus amounts, MTC Credit amounts, expiration periods, eligibility requirements, or related program rules at any time for any reason, including but not limited to legal, regulatory, tax, or business considerations.

Any changes will apply prospectively. Referral bonuses already earned for completed eligible services prior to the effective date of such changes will not be affected.

7.8 No Guarantee

MOVE THAT COUCH! does not guarantee referral tracking accuracy and is not responsible for missed or skipped bonuses due to technical errors, misuse, third-party interference, incorrect referral usage, or system limitations.

8. User Responsibilities

Users are responsible for providing accurate, complete, and lawful information and for using the platform in good faith.

Users managing services on behalf of a client represent that they have obtained permission to share the client’s contact information and to allow MOVE THAT COUCH! to send transactional communications related solely to that service.

9. In-App Messaging, Receipts, and Tax Documentation

In-app messaging is provided to facilitate communication related to service requests and bookings. Messaging may be limited or locked:

Customers receive a platform receipt for the booking deposit paid through MOVE THAT COUCH!. Service providers may optionally generate service provider receipts and W-9 forms through the platform.

MOVE THAT COUCH! does not verify off-platform payments, does not guarantee that a service provider will provide receipts or tax documentation, and is not responsible for provider noncompliance.

10. Transactional Communications

MOVE THAT COUCH! may send transactional notifications via SMS, email, and push notifications related to account activity, service requests, booking confirmations, provider updates, cancellations, and service availability.

Message frequency varies. Message and data rates may apply. Users may opt out of SMS messages at any time by replying STOP or request help by replying HELP.

Users may manage and update their notification preferences, including enabling or disabling SMS, email, and push notifications, at any time through their account settings in the MOVE THAT COUCH! app or website.

MOVE THAT COUCH! does not send marketing, advertising, or promotional SMS messages.

11. Disputes Between Users

MOVE THAT COUCH! is not a party to agreements between customers and providers and does not formally mediate disputes.

12. Prohibited Conduct

MOVE THAT COUCH! reserves the right to suspend or terminate user accounts, restrict access to features, or remove users from the platform at any time for violations of these Terms, misuse of the platform, suspected fraud, abuse, or conduct that may create risk or liability.

13. AI-Powered Features & Automated Tools

MOVE THAT COUCH! may provide certain AI-powered or automated tools and features using internal systems and third-party providers, including tools designed to:

AI-generated outputs, suggestions, analyses, estimates, predictions, and recommendations are provided for informational and convenience purposes only and may be incomplete, inaccurate, inappropriate, delayed, or incorrect.

Users are solely responsible for reviewing and verifying all information before relying on it or submitting it through the platform.

13.1 No Professional Advice or Guarantees

MOVE THAT COUCH! does not guarantee the accuracy, reliability, safety, completeness, legality, suitability, usefulness, availability, or outcomes of any AI-generated output or feature.

AI-generated quote guidance, pricing suggestions, timing expectations, estimated price ranges, equipment recommendations, scheduling suggestions, profile recommendations, request insights, or customer communication prompts do not constitute professional, financial, legal, safety, logistics, transportation, or business advice.

Service providers remain solely responsible for determining:

Customers remain solely responsible for reviewing and confirming the accuracy of service requests, item descriptions, measurements, access conditions, photos, scheduling details, and related information.

13.2 Automated Analysis & Content Review

By using the platform, users acknowledge and agree that uploaded photos, profile information, descriptions, messages, delivery request details, and other submitted content may be processed by automated systems and AI tools for functionality, moderation, fraud prevention, policy enforcement, safety review, feature improvement, quality control, and platform operations.

MOVE THAT COUCH! reserves the right to review, flag, restrict, remove, or investigate content or accounts based on automated or human review processes.

13.3 Third-Party AI Providers

Certain AI-powered features may rely on third-party service providers. User content submitted through AI-powered features may be processed by such providers solely for purposes related to platform functionality and operations.

14. Changes to These Terms

Continued use of the platform after updates take effect constitutes acceptance of the revised Terms.

15. Governing Law

Governed by the laws of the State of Texas.
